Terms & Conditions

1. Definitions

  • Additional Terms and Conditions: the additional general terms and conditions applicable to the Classes, Workshops and Retreats organised by RechargeMe Yoga.
  • The General Terms and Conditions: the general terms and conditions used by RechargeMe Yoga, which have been published on the RechargeMe Yoga website, https://rechargeme.nl.
  • RechargeMe Yoga: RechargeMe Yoga has its official seat at Hofplein 20, 3032 AC Rotterdam and is listed in the Trade Register under number 81128789.
  • RechargeMe Card: a 5- class, a 10-class or a 20-class card, as referred to in Clause 3.
  • Introduction to Yoga Program: a 2-hour introduction session and 2 beginner yoga classes, as referred to in Clause 5.
  • Booking fee: the booking fee, which has to be paid by the Participant upon application for a Workshop or Retreat and is non-refundable.
  • Membership: the membership for attending yoga classes at RechargeMe Yoga, issued or to be issued by RechargeMe Yoga and paid or to be paid by the Student.
  • Single Class: a single yoga class at RechargeMe Yoga to be attended and paid by the Student, other than on the basis of any Membership.
  • Participant: the person who attends or wishes to attend a Retreat or a Workshop.
  • Price: the total price of a Workshop or a Retreat, including the Booking fee, and where applicable accommodation fees.
  • Private Class: a private yoga class at RechargeMe Yoga, for which the Student must make an appointment in advance.
  • Retreat: a yoga retreat organised by RechargeMe Yoga.
  • Teacher: the yoga teacher who has been contracted by RechargeMe Yoga to teach yoga classes.
  • Student: a person who attends and/or wishes to attend private or group yoga classes, retreats or workshops at RechargeMe Yoga.
  • Website: the website of RechargeMe Yoga: https://rechargeme.nl/.
  • Workshop: a yoga- or yoga-related workshop given or to be given by RechargeMe Yoga.

2. Scope of Application

  • The General Terms and Conditions apply to any membership and, where applicable, to all RechargeMe Cards, Single and Private Classes of and at RechargeMe Yoga as well as to all Retreats, and Workshops.
  • By participating in a Retreat, a Workshop, or any class of RechargeMe Yoga, the Student agrees to the applicability of these General Terms and Conditions.
  • RechargeMe Yoga may from time to time amend these General Terms and Conditions. The most recent version of the Terms and Conditions is always the version that is applicable and is always available on the Website. RechargeMe Yoga will announce any amendments to the General Terms and Conditions in advance by email

3. RechargeMe Unlimited Membership – Monthly, RechargeMe Unlimited Membership – Yearly

RechargeMe Yoga offers the following possibilities of attending yoga classes at RechareMe Yoga:

 

1. RECHARGEME UNLIMITED MEMBERSHIP – MONTHLY AND YEARLY 

  • 1.1 The Monthly and Yearly Membership entitles the member to an unlimited number of yoga classes during the term of the Membership.
  • 1.2 The minimum Membership term for the RechargeMe Unlimited Membership Monthly is three (3) months. After the third month, the Monthly Membership is tacitly converted into a continuing agreement for an indefinite period. The minimum Membership term for the Yearly Membership is twelve (12) consecutive calendar months. After the twelve months, a Student’s Membership will automatically end.
  • 1.3 The Membership commences on the agreed starting date and once the first payment is made by IDEAL, SEPA, or Credit Card. The next monthly cycles will be paid by credit card or direct debit (SEPA), until termination.
  • 1.4 After the minimum term of three (3) months, the RechargeMe Unlimited Membership – Monthly may be terminated every month. RechargeMe Unlimited Membership – Monthly must be cancelled 30 days prior to the individual renewal date in order to end membership charges. Cancellation of the RechargeMe Unlimited Membership – Monthly must be done by sending an email to rechargemeyoga@gmail.com. RechargeMe Yoga will not reimburse the Student for the remainder of any paid subscription period, nor will reimbursements be made for membership cancellations prior to any renewal date.
  • 1.5 RechargeMe Unlimited Membership – Yearly Membership may be put on hold for one (1) month during the 12-month period. This month of suspension does not count for the 12-month period; i.e. if the membership is put on hold for one (1) month the end date of the contract will be extended by one (1) month.
  • 1.6 A Student may use any Membership only in the event of payment by credit card or direct debit (SEPA).
  • 1.7 The Membership fee will be debited from the Student’s bank account around 3-7 days after the starting day of the current Membership instalment. If this starts on the 1st of the Month (e.g. 1 May), the Membership Fee will be debited between the 3rd – 7th of this month (e.g. around the 5th of May). In case RechargeMe Yoga is unable to collect the Membership Fee on the first collection moment, there will be 5 automatic retries with approximately 24 hrs intervals between each attempt. After 5 unsuccessful attempts, the student will be blocked from booking classes until the payment has been completed. If the Membership Fee is not paid within two weeks, 20 euros administration costs will be charged.
  • 1.8 All Dutch Bank accounts and bank accounts from European SEPA countries are supported for the direct debit payment (monthly Membership only). Find below a list of the European SEPA countries: Åland Islands (FI), Austria (AT), Belgium (BE), Bulgaria (BG), Canary Islands (ES), Croatia (HR), Cyprus (CY), Czech Republic (CZ), Denmark (DK), Estonia (EE), Finland (FI), France (FR), French Guiana (GF), Germany (DE), Gibraltar (GI), Greece (GR), Guadeloupe (GP), Hungary (HU), Iceland (IS), Ireland (IE), Italy (IT), Latvia (LV), Liechtenstein (LI), Lithuania (LT), Luxembourg (LU), Malta (MT), Martinique (MT), Mayotte (YT), Monaco (MC), Netherlands (NL), Norway (NO), Poland (PL), Portugal (PT), Réunion (RE), Romania (RO), Saint Barthélemy (BL), Saint Martin (French part) (MF), Saint Pierre and Miquelon (PM), San Marino (SM), Slovakia (SK), Slovenia (SL), Spain (ES), Sweden (SE), Switzerland (CH), United Kingdom (GB).
  • 1.9 RechargeMe Unlimited Membership commences when RechargeMe Yoga has received the Membership Fee from the Student.

RECHARGEME SINGLE CLASS

  • 2.1 The RechargeMe Single Class entitles the Student to one (1) yoga class.
  • 2.2 The RechargeMe Single Class is valid for one (1) month from the date of purchase. The single (1) class must therefore be attended within one (1) month of the date of purchase. After that period, this right lapses.

RECHARGEME CARD 5-CLASSES / RECHARGEME CARD 10-CLASSES / RECHARGEME CARD 20-CLASSES

  • 3.1 The RechargeMe Card entitles the Student to five (5), ten (10) or twenty (20) yoga classes.
  • 3.2 The RechargeMe Card – 5 classes are valid for two (2) months after the first visit. The 5 classes must therefore be attended within two (2) months from the first visit. After that period, this right lapses. In case there has been no first visit within 2 months, the 5 class card automatically expires. The RechargeMe Card – 10 classes are valid for three (3) months after the first visit. The 10 classes must therefore be attended within three (3) months from the first visit. After that period, this right lapses. In case there has been no first visit within 3 months, the 10 class card automatically expires. The RechargeMe Card – 20 classes are valid for six (6) months after the first visit. The 20 classes must therefore be attended within six (6) months after the first visit. After that period, this right lapses. In case there has been no first visit within 6 months, the 20 class card automatically expires.

One (1) MONTHLY UNLIMITED CARD

  • 4.1 The one (1) Monthly Unlimited Card entitles the Student to unlimited yoga classes for 30 days.
  • 4.2 The one (1) Monthly Unlimited is valid for 30 days from the date of purchase. The classes must therefore be attended within 30 days from the date of purchase. After that period, this right lapses.

4. Payment and Price Changes

  • All yoga classes organised by RechargeMe Yoga must be paid for before they are held. Payments can be made by cash, direct debit (memberships only), Credit Card (Visa, Master Card), and IDEAL.
  • As a general rule, direct debits for memberships are made monthly around 3-7 days from the starting date of the membership. If the amount cannot be collected, a student will be blocked from booking classes until payment is completed. RechargeMe Yoga reserves the right to change the pricing of all RechargeMe products. Any changes are announced in advance by placing statements on the Website, and/or by email. The currently applicable rates are always mentioned on the website of RechargeMe Yoga.
  • After the RechargeMe Yoga Employee or Teacher has verified the registration and payment for the relevant yoga class, the Student is allowed to enter the class.

5. Reservations and cancellations for yoga classes

  • All classes are available for online booking 14 days in advance.
  • Students can cancel their booking until twenty-four (24) hours before the class starts. The Student can only cancel through the personal account, so not by phone or email.
  • If the Student has a Card and does not show up to the class or does not cancel it up to twenty-four (24) hours in advance, this class will be deducted from the Student’s card.
  • Cancelling an appointment for a private class can be done without charge up to 24 hours before the start of the appointment. The Student will be charged in full if the private appointment is cancelled within 24 hours before the start of the appointment.

6. Schedule

  • The current schedule is mentioned on the Website. RechargeMe Yoga reserves the right to change the schedule at any time. If possible, any changes are announced in advance on the Website or by email.
  • RechargeMe Yoga reserves the right to cancel a yoga class that has been scheduled or to change the yoga teacher mentioned in the schedule in the event of force majeure, including illness of the teacher. In case of replacement of a teacher, there will be no refund of any Membership fee.
  • RechargeMe Yoga reserves the right to close its doors on public holidays or on other days, or when imposed by the government, in case of force majeure, national safety or a pandemic.

7. Early Termination of Membership in case of illness

7.1 In the event of prolonged illness or an injury, the Student may terminate the Membership early. A request for early termination must be submitted to RechargeMe Yoga in writing and RechargeMe Yoga reserves the right to evaluate and handle each case individually. This termination may be sent by email to rechargemeyoga@gmail.com.

8. Liability

  • RechargeMe Yoga accepts no liability for loss or damage of personal belongings of a Student attending yoga classes, workshops, or retreats and leaving belongings in the changing rooms at RechargeMe Yoga. If during a retreat or workshop the student causes loss or damage to property of the venue where the student is staying, the student will be held liable. This loss or damage is in no way covered by RechargeMe Yoga.
  • The student is considered to have the right insurance to cover this loss or damage.
  • RechargeMe Yoga is not in any way liable for personal injuries sustained during yoga classes, workshops, or retreats. Participating is always at the own risk of the Student.
  • RechargeMe Yoga provides the following guidelines for reducing the risk of an injury:
  • Always consult a doctor before starting yoga classes if you are not sure that you are completely healthy or if you are pregnant.
  • If you have an injury or any other physical inconvenience, always inform your yoga teacher about this before starting the yoga class.
  • Listen to and follow the instructions of the relevant yoga teacher.
  • Perform the yoga exercises carefully and bear your physical limitations in mind.
  • Do not perform any yoga exercises that are painful.
  • Ask questions if you do not understand an exercise.
  • Avoid inverted poses during menstruation.
  • Although we strive to only provide correct information on our website, we are not liable for any inaccuracy and no rights can be derived therefrom.

9. Personal Data

  • RechargeMe Yoga collects personal data of the Students and Participants to update its membership records, to execute payment orders and for administration and information purposes. RechargeMe Yoga handles this collection of personal data with due care and complies with the provisions of the Dutch Data Protection Act.
  • RechargeMe Yoga uses the personal data referred to in Clause 9.1 to inform the Students and Participants about activities of RechargeMe Yoga and any changes in the schedule, for example. If the Student or Participant does not want to receive communications from RechargeMe Yoga, he or she may unsubscribe from the mailing in the bottom of a received newsletter or communicate this to RechargeMe Yoga by sending an email to rechargemeyoga@gmail.com. The Student or Participant is aware (s)he cannot use all online services and products of RechargeMe Yoga in that case.
  • RechargeMe Yoga never gives any personal data of the Students or Participants to third parties without their prior written consent.

10. Governing Law and Dispute Settlement

  • The General Terms and Conditions are exclusively governed by Dutch law.
  • Any disputes relating to the General Terms and Conditions, any Membership, a RechargeMe Card, or a Student’s attending group and private yoga classes, Workshops, or Retreats organised by RechargeMe Yoga are settled exclusively by the competent court in Amsterdam or any higher court.

11. Code of Conduct

  • Students shall adhere to RechargeMe Yoga’s code of conduct at all times:
  • Please make sure you are clean and fresh when you attend the yoga class. The use of unscented deodorant is highly appreciated. In view of potential allergies of other Students, everyone is asked not to wear any perfume, aromatherapy oils or other scented products, and not to use any spray deodorant in the changing rooms.
  • RechargeMe Yoga advises not to eat later than two hours before the start of the yoga class and, in any case, not to do yoga on a full stomach.
  • Please do not wear shoes in the yoga studio.
  • To allow everybody to find perfect inner peace, Students are requested not to talk in the yoga studio before, and during the yoga class.
  • The physical and mental integrity of Students must always be respected. Racism, sexual behaviour or sexually suggestive behaviour is not tolerated by RechargeMe Yoga.

RechargeMe Yoga reserves the right to deny Students who do not observe the house rules referred to in Clause 11.1, to deny access to the RechargeMe Yoga premises and to terminate the Membership of the relevant Student without a refund of any membership fee paid already.

ADDITIONAL GENERAL TERMS AND CONDITIONS FOR WORKSHOPS, AND RETREATS OF RECHARGEME YOGA

12. Applicability of Additional Terms and Conditions and Definitions

  • Retreats and Workshops are governed by these Additional Terms and Conditions in addition to the General Terms and Conditions. The General Terms and Conditions form an integral part of these Additional General Terms and Conditions. By participating in a Workshop, or Retreat, the relevant Participant accepts the applicability of the General Terms and Conditions and the Additional General Terms and Conditions.
  • RechargeMe Yoga reserves the right to replace the teachers of Workshops and Retreats in case of illness or injury of the original teacher without further consequences. RechargeMe Yoga will guarantee that the replacement of a teacher will not affect the contents and the quality of the training. Replacement of a teacher will therefore not be accepted as a valid reason for cancellation.

13. Participation in Workshops and Registration

  • A Participant may participate in a Workshop after he or she has registered for it with RechargeMe Yoga in advance and paid the price. A spot in the Workshop is guaranteed once RechargeMe Yoga has received payment of the price and a confirmation of the registration is received in a confirmation email.
  • For some Workshops, an “Early Bird Rate” applies. This reduced rate applies until the date specified on the Website. After this date, the normal rate, which is also specified on the Website, applies without exception.
  • All participants are responsible for having the correct insurance (health, travel and/or liability) needed to participate in the workshop.

14. Participation in Retreats

  • A Participant may participate in a Retreat after he or she has registered for it with RechargeMe Yoga in advance and paid the Price (where applicable including accommodation) including the Booking Fee. A spot in the Retreat is guaranteed after RechargeMe Yoga has received payment of the price (where applicable including accommodation) including the Booking fee and the student has received a confirmation of the registration in a confirmation email.
  • For some Retreats, an “Early Bird Rate” applies. This reduced rate applies until the date specified on the Website. After this date, the normal rate, which is also specified on the Website, applies without exception.

15. Payments and Prices

  • The Price for a Workshop or Retreat can be found on the RechargeMe Yoga website.
  • Payments for a Workshop or Retreat must be made in full before the Workshop or Retreat is held. Payments can be made by direct debit, IDEAL, PIN, or Credit Card (Master or Visa Card). In the event of participation in a Retreat, the Booking Fee must be paid upon registration. The Booking Fee is non-refundable. The remaining balance (where applicable including accommodation) must be paid 90 days before the Retreat scheduled at the latest.
  • If RechargeMe Yoga cancels a Workshop or Retreat for reasons other than force majeure, the Booking Fees and other payments will be refunded in full.
  • The Price for a Retreat, the corresponding Booking Fee and where applicable the accommodation fees are mentioned on the RechargeMe Yoga Website.
  • To complete the application for a Retreat, a Booking  Fee payment, or in some cases the full payment, must be made through the RechargeMe Yoga website via iDEAL, or Credit Card.

16. Cancellation of Workshop Registration

  • Any participation in a scheduled Workshop is non-refundable.

17. Cancellation of Participation in Retreat

  • Any participation in a scheduled Retreat may be cancelled only in writing. This can be done by sending an email to rechargemeyoga@gmail.com.
  • The Retreat Participant may cancel his or her registration four (4) months before the scheduled Retreat. The Booking Fee will not be refunded.
  • If the Retreat Participant cancels his or her registration within three (3) months before the start of the Retreat, the Price (including accommodation) will be charged to the participant.
  • If it turns out at the location of the Retreat that the Retreat Participant cannot participate in the Retreat for whatever reason, the Price (including accommodation) already paid will not be refunded.
  • RechargeMe Yoga reserves the right to cancel the Retreat if there are insufficient participants. In this case, the registration fee already paid by the Participants is refunded as soon as possible.
  • In case of force majeure like a pandemic, natural disaster, terrorist attack, etc., RechargeMe Yoga withholds the right to make adjustments to-, to postpone or to cancel the Retreat without further liabilities.

18. Workshop Schedule

  • The current Workshop can always be found on the Website. RechargeMe Yoga reserves the right to change the schedule at any time. If applicable, any changes are announced in advance on the Website or by email.
  • RechargeMe Yoga reserves the right to cancel a scheduled Workshop in the event of force majeure (including illness of the relevant teacher). In this case, the booking fee already paid is refunded.

19. Health

  • By participating, the Participant declares that he/she is healthy on a medical and mental-health level and is ready to fully participate in the demands of the program of the Workshops or Retreats as the case may be. Additionally, the Participant must be able to support the group learning process. The Participant may be requested to leave the Workshop or Retreat, as the case may be, if it is determined by the Teachers that his/her participation would in any way compromise a safe and cohesive learning environment.
  • By participating in the Workshops or Retreats , as the case may be, the Participant declares that he/she is aware that it is his/her own responsibility to take care of his/her own health and well-being during such training at all times.
  • In addition to the stipulations of article 19.1, RechargeMe Yoga reserves the right to require clinical evaluations or other information to competently evaluate the Participant’s medical and/or mental-health preparedness.

20. Liability

  • RechargeMe Yoga shall not be liable for any injury, loss or damages in connection with, or resulting from, participation in the classes, Workshops or Retreats, as the case may be.
  • The Participant will never engage RechargeMe Yoga, the Teachers, or any of the supporting staff, in legal proceedings relating to possible damages in whatever form, that may be the result of participation in the Classes, Workshops or Retreats, as the case may be.
  • RechargeMe Yoga only works with qualified yoga teachers and will always offer yoga classes of the highest quality. Nonetheless, there is always a risk of injury involved when taking a yoga class. By participating in the Workshops or Retreats, as the case may be, the Participant accepts such risk of injury. RechargeMe Yoga offers the following guidelines to diminish the risk of injury:
  • Consult with a physician when you are not sure you are completely healthy, or if you are pregnant, before starting to take yoga classes.
  • If you have an injury, or other physical issue, inform the yoga teacher thereof before you start your yoga class.
  • Listen to and follow the instructions of the yoga teacher.
  • Be conservative when exercising yoga and listen to your physical limitations.
  • Don’t do any exercises that are painful.
  • Ask questions when you do not understand an exercise.

21. Applicable law, dispute resolution

  • The Dutch law applies exclusively to the General Terms and Conditions.
